S.1348 - details of Z Visa

FAIR gives us some details on the Z visa contained in the Senate immigration bill (S.1348).

However, the details of this Senate compromise prove that it is nothing more than an amnesty. The language creates a “Z” visa program for illegal aliens and illegal aliens only. Specifically, the Senate deal:

  • Provides that Z visas last for 4 years and may be renewed indefinitely.
  • Waives numerous criminal provisions for eligibility purposes and no medical exam is needed up front.
  • Requires state and local governments are required to assist illegal aliens in providing documentation to support a Z visa application as a condition of receiving state impact assistance money.
  • Immediately grants probationary benefits (including work authorization, protection from removal, and a social security number) based only on an application and a 24-hour wait on a background check. Probationary benefits are not affected by the “trigger” in Title I of the bill.
  • Provides that any knowledge of English is required only upon the first renewal of a Z visa (i.e. after four years).
  • Allows Z aliens to apply for green cards and become citizens. While they must wait until some existing applications are processed, they are not required to wait in line behind those who have applied for green cards after May 1, 2005. Moreover, they get to live and work in the U.S. while they wait.
  • Provides that green card applications (for heads of households) must be filed in person outside the U.S. but not necessarily in the alien’s country of origin. The alien can then re-enter under a Z nonimmigrant visa because it serves as a valid travel document.
  • Requires certain fees and a penalties. To become a Z nonimmigrant (head of household only) must pay a $1,000 penalty. To become a legal permanent resident (i.e. obtain a green card), a head of household must pay a $4,000 penalty.

Looks like state and local governments are going to get hammered again if this bill goes through. I also am curious how a background check is to be done on an illegal alien who often times have multiple spellings of their names and fraudulent identities.

This is just another garden variety amnesty pushed through by Kennedy and his ilk with a wrapping to look like they’ve covered security which will never be implemented. These are details found with just a scanning of the supposedly 1000 page bill. Imagine what other onerous details could be contained in the bill?

  3. Forget the Z visas and the citizenship smokescreen. Anyone with any common sense knows that the entire bill is to make 12- 20 million criminals legal.

    As soon as El Presidente Booosh signs the bill they’ve accomplished what they were after- Legal status.

  4. I haven’t done too much searching for it, but from what I’ve heard this “Z-Visa” won’t go into effect until it’s been verified that the border “is secured”. If this is the case we will never ever see a Z-visa.

  5. Okay, found ti with the freepers so I can’t 100% verify its validity:

    Border Security: Border security benchmarks must be met before the Z visa and temporary worker programs go into effect. These triggers include: constructing 370 miles of fencing and 200 miles of vehicle barriers at the border and increasing the size of the Border Patrol to 18,000 agents.

    Unless they pair it down I don’t foresee this happening anytime soon.

  6. Jeremy - those benchmarks are all smoke and mirrors. First thing which will be done is to give green cards to all illegals and then the rest will fall apart with no enforcement. Did you notice who was going to be responsible for “helping” the illegals get processed? I for one, don’t believe this bill will become law. There is no reason to believe any of the enforcement measures will become reality. Both in 1965 and 1986 Kennedy said that will be the end of amnesty for illegals. What makes you think he’ll live up to his commitments with this? He or any other Senators supporting this sham.

  10. Approval of the the immigration reform bill must be incisively reviewed. Illegal immigrants who are considered as asset to our country must be must be given a first priority approval. The categorized liabilities be reviewed further as to what they can contribute. The potential threats must be tract out, investigated. eliminated and deported. This place is not a charitable institution. For me, this is a place where peace loving people believed in best effort work, honestly done, is the key to the success.

  12. I was watching the speech of Sen. Edward Kennedy at the U.S.Senate live at C-SPAN 2 regarding his comment on the Immigration Reform Bill issue. The significant of reconsidering the said bill, inspite that it was tabled in the senate floor, manifest that we always practice freedom to decide for what is good in the humanity. Our country is a welcoming country but let’s be reminded that we have laws to follow. To the oppositionist I will say that what is law now can be abolished and ammended for a better law tomorrow. That is what is good here in our country….that our law is very dynamic. God bless you illegal immigrants. Just pray and be good and the rest will be done by God.
