Pendleton 8 – NCIS’s use of Psychological Torture

Each time I read something more on how the Camp Pendleton 8 have been treated in the hands of NCIS and the Marine Corps I become more baffled.  I don’t understand how the chain of command sees their actions and conduct here as a good thing for the Corps.  This is one of the worst PR Campaigns anyone could conjure.   

The defense has proof the NCIS uses a rubber hose (on prominent display) as a psychological intimidation tactic. What is wrong with these people? These are OUR troops here, not terrorists.

Then there’s the Marine Corps itself. First they go after Ilario Pantano based on a liars testimony, then it’s Haditha charges against Marines (thanks John Murtha for condemning them before being charged) and finally we have the Pendleton 8. All are a disgrace and black mark against the Marine Corps and NCIS.

From Mr. Jodka who’s son JJ is being held;
As to the allegation of coerced statements, Pfc. Jodka’s father, John Jr., described to me the psychological torture he believes his 20-year-old son has endured:

“Immediately after my son was removed from the war zone, literally moments after his rifle was removed from his hands, he was placed in a room for 7 to 7.5 hours ? no food, no water, no sleep ? and he was told that he was a murderer. They hammered away at him to give statements of what it was they wanted to hear.”

On the rubber hose issue:

Said Ms. Seigel of the Naval Criminal Investigative Service: “NCIS was on a mission to place blame and not find the truth. They wanted to make sure that Hamdania did not mimic Haditha. America needs to know that ‘there are all kinds of rubber hoses’ in the offices at NCIS, and that statements can be extracted from prisoners by using intimidation tactics other than physical force. Ask NCIS why they keep rubber hoses in their offices, and why they think it’s funny?”

I did. I called NCIS and asked if rubber hoses were located in their offices and if so, why? NCIS at Camp Pendleton referred me to NCIS headquarters in Washington. NCIS headquarters in Washington told me I would receive an e-mail statement over the weekend. I have yet to receive it. Meanwhile, Ms. Siegal will enter in to evidence a photograph taken at NCIS-Camp Pendleton of a rubber hose on a white board, with the words “my psychological friend” written underneath.

    I have read this reports too, and like you are baffled. This all just doesn’t ring right. If it all turns out to be true I will be equally baffled. So far as the rubber hoses on display there, I can’t help but feel that is a typical ‘Jarine’ attempt at humor. Heck, I knew a commander who kept a big Bowie knife in his office and a block of wood. I recall him telling one of the soldiers in for Article 15 that he had the power to cut off the nuts of anyone who broke his law as he hacked on the wood. In a figurative sense he was right. Was it threatening behavior? Yeah, indirectly I suppose, but very illustrative. Today, a story like that would get this guy relieved and put under the jail like almost happened to the battalion commander who put the gun to an Iraqi’s head while trying to get IED info from him. Today such things are not tolerated. In some ways that is unfortunate and means that we end up having to process a bunch of kids for offenses in the UCMJ process that otherwise could have been turned around with a little “footlocker counseling.”

    Now NCIS and CID have a checkered history of how they do business. But displaying a rubber hose is not something that I would see as anything more than an attempt at wry humor. If though, that rubber hose gets used on one of our folks then the investigating agency has undertaken the tactics of those they accuse others of doing.
